Terms and Conditions

Terms for contracting and using the WIT service.

Important: By registering for WIT or using the service, you agree to these Terms and Conditions. If you have questions, contact us before contracting.

1 Definitions

For purposes of these Terms and Conditions:

  • “WIT”, “we” or “us” refers to the Customer Experience Intelligence service operated by Eclipse Experience LLC, based in Weston, Florida, United States.
  • “Service” refers to the WIT web platform, including dashboards, AI analysis, surveys, Google Reviews integration and associated features.
  • “Customer” or “you” refers to the individual or legal entity contracting and using the Service.
  • “End user” refers to the Customer’s own customers who respond to surveys through the Service.
  • “Data” refers to information processed through the Service, including survey responses, comments and metrics.

2 Acceptance of terms

By creating an account, clicking to accept these Terms or using the Service in any way, you confirm that you have read, understood and agree to be bound by these Terms. If you are acting on behalf of a company, you represent that you have authority to bind that company.

If you do not agree with any provision, you must not use the Service.

3 Service description

WIT is a SaaS Customer Experience Intelligence platform that enables businesses to:

  • Send satisfaction surveys such as NPS, CSAT and CES via WhatsApp, QR code or email.
  • Centralize customer feedback in real time.
  • Analyze comments, emotions and patterns through artificial intelligence.
  • Manage detractor cases and close the loop.
  • Integrate and manage Google Business Profile reviews.
  • Visualize metrics and trends through role-based dashboards.
AI note: AI-generated analysis and recommendations are decision-support tools. WIT does not guarantee absolute accuracy. Business decisions remain the Customer’s responsibility.

4 Registration and account

4.1 Account creation

To use the Service, you must create an account and provide accurate, complete and updated information.

4.2 Access credentials

You are responsible for maintaining the confidentiality of your access credentials and for all activity under your account. You must notify us immediately of any unauthorized access.

4.3 Subaccounts and users

You may create additional users depending on your plan. You are responsible for actions taken by users created under your account.

5 Plans and billing

5.2 Billing

Subscriptions are billed in advance by credit card or another approved payment method. Billing cycles start on the account activation date unless otherwise agreed.

5.3 Additional usage

If you exceed your plan limits, additional packs or upgrades may be required.

5.4 Plan changes

Upgrades may apply immediately. Downgrades generally apply at the beginning of the next billing cycle.

5.5 Taxes and refunds

Prices do not include applicable local taxes. WIT does not provide refunds for periods already billed, except where legally required or expressly agreed in writing.

6 Acceptable use

The Service must be used to manage the customer experience of your business. You agree not to use the Service to send spam, collect data without a valid legal basis, falsify metrics, access other accounts, reverse engineer the platform, resell access without authorization or perform illegal activities.

7 Intellectual property

WIT, its software, design, trademarks, interfaces, workflows, AI models, dashboards and documentation are owned by Eclipse Experience LLC or its licensors. These Terms do not transfer any intellectual property rights to you.

8 Data and privacy

Your use of the Service is also governed by our Privacy Policy. You retain ownership of your business data and customer data. WIT processes such data only to provide, maintain, secure and improve the Service, subject to applicable law and contractual obligations.

9 Service availability

We use commercially reasonable efforts to keep the Service available. However, availability may be affected by maintenance, third-party providers, technical failures, connectivity issues or events outside our reasonable control.

10 Limitation of liability

To the maximum extent permitted by law, WIT will not be liable for indirect, incidental, consequential, punitive or special damages, including lost profits, revenue, goodwill or data. Our aggregate liability will not exceed the amounts paid by the Customer for the Service during the three months preceding the event giving rise to the claim.

11 Cancellation and termination

You may cancel your subscription according to the process available in your account or by contacting us. Access will remain available until the end of the paid period unless the account is terminated for breach.

12 Changes

We may update these Terms from time to time. Material changes may be communicated by email, in-app notice or publication on our website. Continued use after the effective date constitutes acceptance of the updated Terms.

13 Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles. Any dispute will be submitted to the competent courts located in Florida, unless mandatory law provides otherwise.
